HyperNerd Inc. Terms of Service

General: I authorize The HyperNerd Computer Force to perform work on my computer. I understand that The HyperNerd Computer Force technicians have been trained to perform computer hardware and software work, but The HyperNerd Computer Force or it's technicians may or may not be an authorized service dealer of a given system, component, peripheral, software or accessory. Further, I agree to release, indemnify, and hold harmless The HyperNerd Computer Force, it's employees and contractors from liability for any claims or damages of any kind or description that may arise from any computer work performed on my computer, even if caused by negligence of The HyperNerd Computer Force. I understand that The HyperNerd Computer Force is not responsible for any data loss, which may occur as a result of work done on my computer.
Manufacture Warranties: I understand that technical support rendered by The HyperNerd Computer Force may void manufacturer warranties for this computer system. The HyperNerd Computer Force does not assume any liability or warranty in the event that the manufacturer warranties are voided.
Estimated Completion Time: The HyperNerd Computer Force will provide an estimated completion time for your
repair/install if the service is to be completed offsite. Unforeseen circumstances may have an impact on our ability to complete the repair(s) as provided in the estimate.
Repair Estimate: An estimate as required (Section 9844 of the California Business and Professions Code) for repairs shall be given to the customer by The HyperNerd Computer Force in writing, and The HyperNerd Computer Force may not charge for work done or parts supplied in excess of the estimate without prior consent of the customer. Where provided in writing, The HyperNerd Computer Force may charge a reasonable fee for services provided to determine the nature of the malfunction when preparing a written estimate for repair. Impact of Upgrades: Please be advised that it is your responsibility to understand the impact of upgrades to the operating system, applications and utility software. Such upgrades can lead to incompatibilities and the possible loss of data. Computer hardware and software work together and incompatibility may not become apparent until a later date. You are responsible for contacting the manufacturer of your software regarding compatibility issues before you request any upgrades.
Loss of Data: Data is the most important part of a computer system because it is often irreplaceable. Due to the process of repair, data may get damaged or at worst, deleted. The HyperNerd Computer Force is not responsible for the loss of any data which may occur while performing work on your computer. You are responsible for backing up our own data. You may request that the HyperNerd Computer Force back up your data for you at the stated price;
however, we do not guarantee any backup.
Responsibility: It is your responsibility to back up all software and data on your computer's hard drive(s) and/or any other storage devices before the HyperNerd Computer Force technicians arrives. The HyperNerd Computer Force and/or its third-party service provider shall not be responsible at any time for any loss, alteration, or corruption of any software, data, or files.
Ownership:
You must own the computer that is to be repaired. The HyperNerd Computer Force will return the computer only to its owner when the repair(s) are complete. You must own and demonstrate ownership of any software that is to be installed or re-installed on your computer by the HyperNerd Computer Force by bringing in the original Software CDs and the appropriate keys and/or serial numbers.
Privacy: Our Technicians will not browse through your hard drive looking at your data; however, they may inadvertently see data during the course of their work. Please remove any personal or private files you do not want others to see.
Right to Refuse: In its sole discretion, the HyperNerd Computer Force reserves the right to refuse work that it believes is beyond the scope of its ability or for other good cause.
Abandonment: If you do not pick up your equipment within ninety (90) days after we notify you that the requested service is complete, we will treat your equipment as abandoned. You agree to hold the HyperNerd Computer Force harmless for any damage or claim for the abandoned property. Any and all charges are still your responsibility.
Scope of Work: The HyperNerd Computer Force will only perform the work agreed upon when you bring your computer in for repair. You must authorize, in writing, any additional work which may be required.
Access: The HyperNerd Computer Force Agent must have 1) access to your residence or business and the computer(s) and/or peripheral(s) to be serviced, 2) your consent and cooperation to enter your residence or business, 3) a safe working environment, work space, and 4) electrical power. If the The HyperNerd Computer Force technician determines that these conditions have not been met, services will be denied and a $99 cancellation charge assessed.
Legal Notice: HyperNerd Computer Force refers to a line of technology services provided by HyperNerd Inc. Any reference to The HyperNerd Computer Force in these Terms of Service is a reference to HyperNerd Inc.
Changes Cancellations and Refunds
 - To change your order: You must contact The HyperNerd Computer Force Guidance Engineers at 1-877-Nerd-24-7 (1-877-637-3247).
To cancel your order: You must contact HyperNerd Computer Force Agents at 1-877-Nerd-24-7 (1-877-637-3247) at least 2 hours prior to the scheduled service. The payment amount will be fully refunded in the manner the purchase was paid. If you are not satisfied with your service: Call 1-877-Nerd-24-7 (1-877-637-3247) for resolution. We stand behind our In-Home Service for 30 days. If there is a problem with the service we provided and you notify us within the allotted time period, we will work to remedy the problem quickly and at no additional cost.
Force Majeure: 
If The HyperNerd Computer Force and/or its third-party service provider's ability to render services is impaired by circumstances beyond the control of The HyperNerd Computer Force and/or its third-party service provider, The HyperNerd Computer Force and/or its third-party service provider may choose not to provide services.
Limitation of Remedy: 

Under no circumstances shall HyperNerd Inc, The HyperNerd Computer Force, and/or its third-party service provider be liable to you or any other person for any damages, including without limitation any indirect, incidental, special or consequential damages, expenses costs, profits, lost savings or earnings, lost or corrupted data, or other liability arising out of or related to the services provided by The HyperNerd Computer Force and/or its third-party service provider or out of the installation, de-installation, use of, or inability to use your computer equipment, hardware, peripherals, or the network as a result of the services provided hereunder.
The HyperNerd Computer Force shall not be liable for any failure or delay in performance due to any cause beyond its control. If The HyperNerd Computer Force’s ability to render services is impaired by your failure to cooperate or circumstances beyond the control of The HyperNerd Computer Force, The HyperNerd Computer Force may choose not to provide services. Service can also be denied if dangerous or unhealthy conditions are present including possible code violations. For any un-installation services provided, The HyperNerd Computer Force shall not be responsible for repairing any damage or changes made to your residence.
Limitation of liability & Release: 
By signing this form on the bottom of this page, you agree to release and hold harmless HyperNerd Inc., The HyperNerd Computer Force, and/or its third-party service provider from and against any loss, liability, or damage, including without limitation, any indirect, incidental, special or consequential damages, expense, costs, profits, lost savings or earnings or liability that you, the owner, or lessee may suffer arising out of, or related to, the services provided by The HyperNerd Computer Force. This includes but is not limited to data loss or lack of function in any component or element of your computer system and/or peripherals, any changes or alterations to your residence (for example, changes to walls, baseboards, floors, etc.) as a result of The HyperNerd Computer Force and/or its third-party service provider's agents, partners, and/or third-party service providers, regardless of the warranties, disclaimers, and waivers particular service and shall constitute liquidated damages and are a reasonable estimate of damages to you. Some states do not allow limitations or release of certain damages or liability, so the above limitation of liability and release may not apply to you.
